1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "your") and Elahi Welfare Foundation ("EWF," "we," "us," or "our"), a 501(c)(3) tax-exempt nonprofit organization (Tax ID: 83-0403238), concerning your access to and use of the website located at elahiwf.org (the "Website").

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Website immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Website and all its content, features, and functionality — including but not limited to text, graphics, logos, images, photographs, and the design, selection, and arrangement thereof — are owned by Elahi Welfare Foundation and are protected by United States and international copyright, trademark, and other intellectual property laws.

Donations made through the Website are processed by third-party payment processors, specifically Zeffy and PayPal. We do not directly collect, process, or store any payment or financial information on this Website. When you choose to make a donation, you will be redirected to the respective third-party platform, and your transaction will be governed by their terms of service and privacy policies.

All donations to Elahi Welfare Foundation are tax-deductible to the extent permitted by law. Donation receipts will be provided for your records.

Donations are voluntary and generally non-refundable. If you believe a donation was made in error, please contact us at admin@elahiwf.org and we will review your request on a case-by-case basis.

6. Third-Party Websites and Services

The Website may contain links to third-party websites and services, including but not limited to Zeffy, PayPal, and Facebook. These third-party links are provided for your convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party websites or services.

9. Dispute Resolution

Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms (each a "Dispute"), you and we agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other party.

Binding Arbitration

If a Dispute is not resolved through informal negotiations, the Dispute shall be exclusively resolved through binding arbitration. The arbitration shall be held in the State of Texas, United States. This arbitration agreement applies to disputes brought in the United States. If the arbitration fees are deemed excessive, we will pay such fees as determined to be necessary for the arbitration to proceed.

YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU AND ELAHI WELFARE FOUNDATION ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

Litigation

If a Dispute proceeds in court rather than through arbitration, the Dispute shall be filed and adjudicated in the state and federal courts located in the State of Texas, United States, and you and we consent to the personal jurisdiction of such courts.

10. Limitation of Liability

IN NO EVENT SHALL ELAHI WELFARE FOUNDATION, ITS DIRECTORS, OFFICERS, VOLUNTEERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION SHALL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
